The THEBOT platform (hereinafter “THEBOT”) provides solely a technical tool in the form of a software-as-a-service solution (SaaS). THEBOT does not provide any financial services, investment services, or investment advice within the meaning of Directive 2014/65/EU (MiFID II), Regulation (EU) 2023/1114 (MiCA), or any national financial market laws.
1. No Financial Product – No Investment Advice
All content, information, visualizations, algorithms, and functions on the THEBOT platform do not constitute investment advice, investment recommendations, an offer, or a solicitation to buy, sell, or hold cryptocurrencies, commodities, securities, or other financial instruments. The use of the THEBOT platform does not replace advice from a licensed financial or investment advisor.
2. No Custody or Management of Client Funds
THEBOT does not at any time hold, manage, or control users’ funds, cryptocurrencies, or other assets. All trading transactions are executed exclusively via the user’s own cryptocurrency exchange. The connection between the THEBOT platform and the user’s cryptocurrency exchange is established solely through an API interface created and configured by the user. THEBOT is expressly not granted any authority to make withdrawals, deposits, or transfers of the user’s assets.
3. User Responsibility
The user bears sole and full responsibility for:
- the configuration of parameters within the THEBOT dashboard,
- starting and stopping the bot,
- the selection of the cryptocurrency exchange used,
- all trading decisions resulting from the use of the bot,
- the protection of their API keys and access credentials.
THEBOT is a tool for automating trading parameters defined by the user. THEBOT does not make autonomous investment decisions on behalf of the user.
4. Risk Notice – Cryptocurrencies & Financial Markets
Trading cryptocurrencies, commodities, and securities involves substantial risk. The value of cryptocurrencies can fluctuate significantly within a short period of time and may be lost entirely. Past performance is not a reliable indicator of future results. Users should never invest more than they are willing to lose in full. THEBOT expressly recommends obtaining independent financial advice before using the platform.
5. Backtest Results – Express Notice
To the extent that THEBOT publishes or provides access to backtest results or historical simulation data, the following expressly applies:
Backtest results are based on historical market data and simulated trading conditions. They were calculated under idealized conditions and may not take into account actual trading costs, slippage, liquidity constraints, or market interruptions. Backtest results do not constitute a forecast, guarantee, or indicator of future performance. There may be significant differences between simulated and actual performance.
6. No Guarantee of Profit or Returns
THEBOT does not guarantee profits or any specific return. Any statement regarding historical backtests or system behavior is expressly not a representation of future results. THEBOT excludes any liability for financial losses arising from the use of the platform, to the extent that such losses are not caused by intentional misconduct or gross negligence on the part of THEBOT.
7. Limitation of Liability
THEBOT’s liability is, to the extent permitted by law, limited to the amount paid by the user in subscription fees to THEBOT during the three months preceding the event giving rise to the claim. THEBOT shall not be liable for indirect damages, loss of profit, data loss, or damages caused by actions of third parties, in particular cryptocurrency exchanges.
8. Regulatory Notice
THEBOT does not provide regulated financial services under MiFID II, MiCA, or comparable national laws. THEBOT does not hold user capital, does not provide portfolio management, and does not act as a broker, market maker, or investment advisor. Users are solely responsible for determining whether the use of THEBOT is lawful in their respective jurisdiction.
9. Geographical Notice
THEBOT directs its services to users in the European Union and selected other countries. Persons from countries in which automated trading or the trading of cryptocurrencies is legally restricted or prohibited are not permitted to use the THEBOT platform.
10. Right to Amend
THEBOT reserves the right to amend this disclaimer as well as all content, functions, and the pricing model of the platform at any time. Users will be informed of material changes in due time.
